Regulations for online payments (monetary donations)
The following terms and conditions set out the rules for making online donations of a monetary nature for the statutory purposes of the Polish Sarcoma and Melanoma Patients Association.
1. Definitions
1.1. Donor - a natural person, legal entity, or organization without legal personality
1.2. Recurring donation – a fixed monetary payment in PLN in the amount set by the Donor and transferred to the Association by means of a Continuous Payment Authority via the internet
1.3. One-off donation – a one-time monetary payment in PLN transferred by the Donor to the Association

2. General provisions
2.1. The website is owned by the SARCOMA Association
2.2. Online monetary donations in support of the Association's statutory purposes can be made via the website, https://onkobieg.pl/przekaz-darowizne
2.3. When visiting and using the website, https://onkobieg.pl/przekaz-darowizne, the Donor is obliged to comply with the Regulations set out on the web page.
2.4. The transfer of a monetary donation by the Donor via https://onkobieg.pl/przekaz-darowizne is understood to mean consent to the provisions of these Regulations.
2.5. Use of the website https://onkobieg.pl/przekaz-darowizne is without charge.
3. Method of making cash donations
3.1. The transfer of monetary donations to support the statutory activities of the Association is made possible by using the services provided by the Payment Gateway Service Provider
3.2. The Payment Gateway Service Provider’s responsibility extends to: (a) the collection of a one-off or recurring donation in a fixed amount set by the Donor; (b) the transfer of the requested amount to the Association's bank account by means of online transfer, or by payment cards approved by banks for transactions in the online marketplace, i.e. MasterCard (credit, debit, business); Maestro; Visa (credit, debit, business).

3.4. One-off donations can be made via online transfer or by payment cards approved by banks for transactions in the online marketplace.
3.5. Recurring donations can only be made using payment cards as part of the sign-up process, as this eliminates the necessity to provide payment card details for each subsequent transaction.
3.5.1. By setting up a recurring donation the Donor agrees to the cyclical, monthly collection by the payment gateway service provider of a monetary amount corresponding to the value of the first submitted donation.
3.5.2. As part of the terms and conditions of subscription, the Payment Gateway Service Provider will store the data of the Donor's payment card, including the virtual ID of the Donor's card, as an electronic payment instrument in order to facilitate the transfer of recurring donations.
3.5.3 The online payment instrument is used only to facilitate recurring donations into Association's bank account. The association itself does not have access to the details of the Donor’s payment card.
3.5.4. In the event of any issues regarding recurring donations (if, for example, you wish to subscribe, unsubscribe or change of amount) please get in touch at the following e-mail address: twojedane@sarcoma.pl
3.5. The Payment Gateway Service Provider does not charge any fees to the Donor for the service it provides.
3.6. The choice between a one-off or a recurring donation is solely that of the Donor.
3.7. The Donor has sole responsibility for setting the amount of a one-off or recurring donation.
3.8. The Donor will receive an online communication regarding his/her one-off donation, enabling the data contained within it to be retained.
3.9. If a one-off or recurring donation is returned to the Donor for any reason, the Donor will be immediately notified.
4. Return of donations
4.1. One-off donations and recurring donations are nonrefundable except in cases covered under current legislation

6. Unsubscribing

6.2. It may take up to fourteen working days for your request to come into effect.
7. Privacy Statement
7.1. As part of our provision of services, the website https://onkobieg.pl/przekaz-darowizne collects relevant data in order to provide an efficient and trustworthy framework for the giving of donations, and in order to contact you in the event of any problems.
7.2. The data controller of collected personal data is the SARCOMA Association
7.3. Personal information will be processed as part of the completion and implementation of the donation contract pursuant to art. 6, clause 1, pt b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data, and on the free movement of such data, and repealing Directive 95/46 / EC (GDPR).
7.4. The body that processes personal data is the Payment Gateway Service Provider
8. Amendments to the regulations
8.1. The proprietor of the website reserves the right to amend the Regulations at any time.
8.2. Amendments to the Regulations will be published and make freely available on the website: www.onkobieg.pl
8.3. Amendments to the Regulations will come into force seven days after being published on the website.
9. Final provisions
9.1. Regulations are freely available on the website, www.onkobieg.pl
9.2. The law applicable to the provisions of the Regulations is Polish and European Union law, in particular the Civil Code and the Act of 18 July 2002 on the provision of online services (Journal of Laws of 2011, item 1219, as amended).
9.3. Disputes regarding the functioning of the Owner's website will be settled in the common court based in Warsaw. The decisions of the court are not, however, binding within the meaning of the Civil Code.
